PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE WEBSITE. By accessing or using GulfSelection.com (the “Website”), you agree to be bound by the following Terms & Conditions. If you do not agree with any part of these terms, you must not use this Website or any services provided through it.
1. General
GulfSelection.com is an e-commerce website owned by ORSA Retail General Trading Co. L.L.C and operated in Dubai, United Arab Emirates, with our office at Royal Class Business Center, Arjumand Offices and Retail 308-388, P.O. Box 294474, Dubai Investments Park, Dubai, UAE. By accessing this Website and/or placing an order or requesting a delivery, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you may not use or access the Website. We reserve the right to update or modify these Terms & Conditions at any time. Any changes will be effective once posted on the Website (with the updated date). It is your responsibility to check this page periodically for updates. Your continued use of the Website after any modifications constitutes your acceptance of the revised Terms. We also reserve the right to modify or withdraw any part of the Website (such as adding or removing features, content, or services) temporarily or permanently, with or without notice, and you confirm that we shall not be liable to you or any third party for any such modification or withdrawal.
2. Eligibility
To make a purchase on Gulf Selection, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is higher. By placing an order, you represent and warrant that you are legally capable of entering into binding contracts and that you meet this age requirement. If you are under 18, you may use the Website only with the involvement and supervision of a parent or legal guardian, and we reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we believe that the age requirement is not met.
3. Product Information
We strive to display and describe our products as accurately as possible. However, we do not warrant that product descriptions, photographs, pricing, or other content on the Website are complete, accurate, or error-free. Product packaging and contents may occasionally differ slightly from the images or descriptions (for example, manufacturers may update their packaging or formula without notice). All weights, measures, and similar descriptions are approximate and provided for convenience. Pricing Errors & Accuracy: In the event of any error or omission (including but not limited to incorrect pricing, availability, or product description), we reserve the right to correct such information and, if an order has been placed, to contact you for instructions or cancel your order prior to shipment. If we have to cancel an order because of an error, you will be refunded in full for any amount charged. Gulf Selection shall have no liability for content that is outdated or for any typographical or system errors. Product Availability: All products shown on our Website are subject to availability. We may limit the quantities of any products we offer, and we reserve the right to discontinue any product at any time.
4. Orders
By placing an order through our Website, you are making an offer to purchase the product(s) selected, subject to these Terms & Conditions. Once you submit your order and payment, we will send you an order acknowledgment email summarizing the items in your order. This acknowledgment does not signify our acceptance of your order; it is simply a confirmation that we received it. Order Acceptance: Our acceptance of your order, and the formation of a binding contract between you and Gulf Selection, will occur only when we dispatch the product(s) to you (or begin providing the service you ordered). We reserve the right to accept or reject any order in our discretion. Until the goods are dispatched, no contract is formed. If we decline to accept your order, we will attempt to notify you using the contact information you provided.
Non-Acceptance of Orders: We may refuse or cancel an order for any reason, including but not limited to the following circumstances:
- The product you ordered is out of stock or unavailable.
- We are unable to obtain authorization for your payment or suspect fraud.
- There was an obvious error in pricing, product description, or other relevant information on our Website.
- You do not meet the eligibility criteria or other terms of this Agreement (for example, you are under the required age or the delivery address is outside our service area).
If your order is canceled after payment has been processed, we will issue a full refund of the amount paid by you (using the original payment method). Order quantity limits may apply; we reserve the right to limit the number of units of any products ordered per person, per household or per order. These restrictions may be applied to orders placed by the same account, the same credit card, and/or orders that use the same billing or shipping address. If such limits apply, we will inform you. Order Changes and Cancellations: You may request a change or cancellation of your order by contacting us before the order has been processed for shipment (see FAQ on order changes). Once an order is being prepared or has shipped, changes or cancellations may not be possible. We also reserve the right to cancel orders at our discretion (with a full refund) if, for example, a product is mispriced, we suspect a violation of these Terms, or under circumstances where cancellation is necessary to prevent harm or fraud.
5. Pricing & Payments
All prices displayed on GulfSelection.com are in United Arab Emirates Dirhams (AED), unless explicitly stated otherwise. Prices include any applicable VAT (Value Added Tax) as required by UAE law, unless indicated that a price is exclusive of VAT. We take care to ensure that pricing on the Website is accurate; however, if an error in the price of a product is discovered, we will handle it as described in section 3 (Product Information) above.
Payment Methods: We accept major UAE-issued credit and debit cards for online payment (and most non-UAE issued cards with a Visa or MasterCard logo). All payments are processed securely through our trusted payment gateways which are PCI-DSS compliant, meaning they meet high security standards for processing payment data. Your card details are transmitted directly to the payment processor over encrypted connections and are not stored on our servers. We will never ask you to share your card PIN or online banking passwords. If you choose “save card” functionality (if available), note that card information is stored by the payment processor, not by us, in accordance with security standards.
Your card or payment account will be charged at the point of checkout for the amount of your order (after you confirm and submit the order). In some cases, we may pre-authorize your card or take a small temporary authorization to verify payment, which will be adjusted to the final amount. If paying by card, you must use a card that you are authorized to use, and by confirming your order, you confirm that the card or account is yours or that you have permission from the owner to use it. If the issuer of your payment card refuses to authorize the transaction, we will not be able to process your order and will not be liable for any delay or non-delivery.
Currency and Exchange: Charges for orders will be in AED. If you use an international card, your bank may charge conversion fees or the amount might differ slightly based on exchange rates or bank fees – such differences are beyond our control.
We reserve the right to modify our accepted payment methods at any time, or to offer alternative payment options (such as cash on delivery or installment payment services) for certain orders or promotions. Any such options will be indicated on the Website at checkout if available.
6. Delivery
Delivery Areas: We currently deliver across the entire United Arab Emirates. We do not offer international shipping at this time beyond the UAE. The available delivery location options will be presented to you at checkout. It is your responsibility to provide a complete and accurate shipping address and contact information for delivery.
Delivery Timeframe: Our standard delivery window is 1–3 working days (excluding Fridays and public holidays in the UAE) for most orders within major cities. Deliveries to remote or less accessible areas may take longer (generally up to 3-5 working days). While we strive to meet these estimated delivery times, they are estimates and not guarantees. Actual delivery times may be subject to factors beyond our control, such as courier delays or unexpected demand. We will make reasonable efforts to inform you if we become aware of an unexpected delay.
Risk of Loss & Title: All purchases from Gulf Selection are made pursuant to a shipment contract. This means that title to, and the risk of loss of or damage to, the products pass to you upon our handover of the items to the courier/delivery service for shipment. We are not responsible for any loss or damage to the products after handing them over to the courier, but we will assist you in resolving any courier issues to the extent possible. You will own the goods once they are delivered to the address you provided (provided full payment has been received).
Delivery Process: Deliveries will be made by our third-party logistics partners or couriers to the address specified in your order. You (or an adult representative) should be available to receive and sign for the delivery. The courier may contact you at the phone number provided to coordinate the delivery timing. If you anticipate not being available, you may designate someone (18 years or older) to receive the delivery on your behalf, or contact us to reschedule. Upon delivery, please inspect the package for any obvious damage or missing items and inform the courier or our customer service of any issues (see “Delivery Issues” below).
Failed Delivery Attempts: If the courier is unable to complete the delivery due to an incorrect address, inability to contact you, or nobody being available to accept the package, they will generally attempt a second delivery. If after repeated attempts the delivery fails, we reserve the right to cancel the order. In such case, you may be refunded for the product cost, minus any shipping fees incurred for the failed delivery (subject to our discretion and the circumstances). Alternatively, we may arrange a new delivery date with you, in which case additional re-delivery fees could apply. We will always try to communicate with you to resolve delivery issues before canceling an order.
No Liability for Delays: Gulf Selection is not liable for delays or delivery failures caused by events beyond our reasonable control. This includes, for example, delays due to natural disasters, acts of war, pandemic-related disruptions, government restrictions, customs clearance issues, or any other “force majeure” events. However, if a delay occurs, we will do our best to inform you and to minimize the impact (e.g., by adjusting delivery plans or offering alternatives when possible).
7. Returns & Refunds
For information on returns, exchanges, and refunds, please refer to our Refund & Return Policy below, which is incorporated into these Terms & Conditions by reference. In summary, we accept returns of goods that are defective, damaged, or incorrectly supplied, provided you contact us within the specified time (48 hours of delivery) and return the item unused in its original packaging. Items not eligible for return include perishable goods and items that have been opened or used (unless they arrived damaged/defective). Approved returns will be refunded to the original payment method within 7–14 business days after we process the return. For full details, please see the policy below. By making a purchase, you acknowledge that you have read and agree to the Refund & Return Policy. We reserve the right to refuse any return that does not meet our policy conditions.
8. Prohibited Uses
You agree to use the Website only for lawful purposes and in accordance with these Terms. You must not misuse the Website or engage in any activities that could harm Gulf Selection, other users, or impair anyone’s use of the Website. Prohibited activities include, but are not limited to:
· Fraudulent or Illegal Conduct: You may not use the Website to commit fraud, impersonate any person or entity, or misrepresent your identity. You shall not engage in any activity that violates any law or regulation through the use of our service.
· Disruption of Service: You may not attempt to interfere with or disrupt the operation of the Website or Gulf Selection’s services. This includes spreading viruses, malware, or any other harmful code; launching any denial-of-service (DoS) attacks; or using any robot, spider, scraper, or other automated means to access the site for any purpose without our express permission.
· Unauthorized Access: You must not attempt to gain unauthorized access to any part of the Website, other users’ accounts, or any systems or networks connected to the Website. Similarly, you should not probe, scan, or test the vulnerability of our system or network or breach security or authentication measures.
· Data Mining or Extraction: You may not use any manual or automated process to systematically retrieve, index, or data-mine the Website or its content, or to collect information about other users (including email addresses) without our prior consent.
· Content Misuse: You may not use the Website to transmit or post any harmful, threatening, defamatory, obscene, harassing, or otherwise objectionable content. Any content you submit (such as product reviews or comments, if applicable) must be respectful, accurate, and lawful. You also agree not to use the Website to advertise or promote any products or services that are not provided by Gulf Selection, and not to solicit other users for commercial purposes.
· Resale or Commercial Use: The Website and products sold are provided for personal, consumer use only. You may not use the Website to purchase products for the purpose of reselling or distributing them commercially without our prior written permission. Any unauthorized resale of our products is strictly prohibited and may result in cancellation of orders and legal action.
Violation of any of the above rules may result in termination of your access to the Website and may expose you to civil and/or criminal liability. Gulf Selection reserves the right (but not the obligation) to monitor any activity and content on the Website, and to investigate any suspected breach of these Terms. We may take any appropriate action, including suspension or termination of access, removal of content, and legal proceedings if necessary.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Gulf Selection (and our owners, officers, employees, affiliates, agents, suppliers, and partners) shall not be liable for any indirect, incidental, special, consequential, or exemplary damages that result from your use of (or inability to use) the Website or from the purchase or use of products via the Website. This exclusion includes, for example, damages for loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or other intangible losses, even if we have been advised of the possibility of such damages. We are also not liable for any reliance by you on any content obtained from the Website or for any mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance of the Website.
In addition, to the maximum extent permitted by law, our total aggregate liability to you for all claims arising from or related to your use of the Website or purchase of products, under any legal theory (including contract, tort, or otherwise), shall not exceed the total amount paid by you to Gulf Selection for the specific product or service that is the subject of the claim. If no purchase is involved, our liability is limited to the maximum extent permitted by law.
Exceptions: Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot be excluded under UAE law. For instance, we do not seek to exclude liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by our gross negligence or willful misconduct, or any other liability which cannot be limited or excluded by law.
Consumer Rights: If you are using our services as a consumer (for personal, non-commercial use), the limitations and exclusions above are subject to your statutory rights under applicable law. Nothing in these Terms affects your statutory rights. In the event that UAE law does not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under applicable law.
You agree that these liability limitations are agreed allocations of risk constituting part of the consideration for Gulf Selection’s services to you, and such limitations will apply even if any limited remedy fails of its essential purpose.
10. Intellectual Property
All content included on the Gulf Selection Website – such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software – is the property of ORSA Retail General Trading Co. L.L.C (Gulf Selection) or its content suppliers and is protected by United Arab Emirates and international intellectual property laws. The compilation of all content on this site (meaning the collection, arrangement, and assembly of all materials) is the exclusive property of Gulf Selection. All software or technology used on the site is either Gulf Selection’s property or used under license.
Copyright: You may not copy, reproduce, modify, publish, transmit, distribute, publicly display, or create derivative works from any of the material on our Website without our express prior written permission. Gulf Selection grants you a limited license to access and make personal use of the Website for non-commercial purposes – such as viewing content, placing orders, and storing records of your purchases. However, this license does not allow you to download (other than page caching) or modify any portion of the site, except with express consent. You may not use any meta tags or any other “hidden text” utilizing Gulf Selection’s name or trademarks without our express written consent.
Trademarks: All trademarks, trade names, service marks, brand names, and trade dress on the Website (including the Gulf Selection name and logo) are proprietary to Gulf Selection or the respective brands and suppliers that offer products via our platform. Gulf Selection’s trademarks and trade dress may not be used in connection with any product or service that is not Gulf Selection’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Gulf Selection. All other trademarks not owned by Gulf Selection that appear on this site are the property of their respective owners, who may or may not be affiliated with or connected to Gulf Selection.
User Content: If you submit any content (such as product reviews, comments, or testimonials) on the Website, you grant Gulf Selection a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, publish, translate, and display such content throughout the world in any media. You represent that you own or control all rights to the content that you post and that the content is truthful and does not violate these Terms or any law. We have the right (but not the obligation) to monitor and edit or remove any activity or content. We take no responsibility and assume no liability for any content posted by you or any third party.
11. Privacy & Data Protection
Your privacy is very important to us. Our collection, use, and disclosure of personal information in connection with your use of the Website are described in our Privacy Policy (see above). By using the Website or placing orders, you acknowledge that you have read our Privacy Policy and understand how we collect and process your data. We will treat all personal data in accordance with UAE data protection laws and our posted policy. If you do not agree with our handling of personal information as described, please do not use our services. In the event of any conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy will prevail.
12. Governing Law and Miscellaneous
These Terms & Conditions, and any dispute or claim arising out of or in connection with them or your use of the Website (including non-contractual disputes or claims), shall be governed by the laws of the United Arab Emirates. By using this Website, you expressly agree that the courts of the United Arab Emirates shall have exclusive jurisdiction to adjudicate any disputes arising in connection with these Terms or your use of the site, and you hereby submit to the jurisdiction of those courts. If you are a consumer residing outside the UAE, you may also be entitled to certain rights or remedies under the laws of your country of residence; these Terms are not intended to limit such mandatory consumer protections.
Severability: If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a competent authority, that provision shall be deemed severable from the remaining terms, and shall not affect the validity and enforceability of the other provisions, which shall remain in full force and effect.
No Waiver: Our failure to enforce any right or provision under these Terms shall not constitute a waiver of that or any other provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Gulf Selection.
Entire Agreement: These Terms & Conditions, together with any policies or documents expressly referred to herein (such as the Privacy Policy and Refund & Return Policy), constitute the entire agreement between you and Gulf Selection regarding the Website and your purchase of products through it. They supersede any prior or contemporaneous communications and proposals, whether oral or written, between you and us (including any prior versions of the Terms).
Assignment: Gulf Selection may assign or transfer its rights and obligations under these Terms to another entity in the event of a merger, acquisition, or sale of assets, or by operation of law or otherwise. You may not assign, transfer, or sub-license any of your rights under these Terms without our explicit consent.
Headings: The section titles in these Terms & Conditions are for convenience only and have no legal or contractual effect.
